Important notice about emergencies

This website is not an emergency channel.

In case of a medical emergency, call SAMU on 192, or the Fire Brigade on 193, or go immediately to the nearest emergency department.

Our digital channels, the ombudsman and WhatsApp, are not monitored in real time and do not replace in person care. A message sent through them may take hours or days to be read.

1. About these Terms

These Terms govern the use of the website of Hospital Santa Casa de Martinópolis, registered under CNPJ number 52.268.596/0001-09, and of the digital channels offered on it.

By browsing the website or using its channels, you agree to these Terms. If you do not agree, do not use them.

These Terms concern the use of the website. They do not govern the provision of health care, which is governed by the care relationship, by the rules of the Brazilian public health system and of the applicable health plans, and by health legislation.

2. The content of this website is not medical advice

The information published here, such as news, campaigns, health guidance and institutional content, is informative and educational in nature.

It does not constitute a diagnosis, a prescription or individual clinical advice, and it does not replace consultation with a qualified health professional. No decision about your health should be made solely on the basis of what you have read here.

We aim to keep the content correct and up to date, but it may contain inaccuracies or be outdated in relation to current practice.

3. Permitted use

You may use the website to learn about the hospital, to consult documents on the transparency portal, to read news and to use the ombudsman and service channels for the purposes for which they exist.

4. Prohibited use

When using the website, you agree not to:

1) file a false report, or impersonate another person;

2) send unlawful, offensive or discriminatory content, or content that infringes the rights of others;

3) send another person's health data without a legitimate reason for doing so;

4) attempt to gain unauthorised access to systems, accounts or data;

5) carry out scanning, mass automated scraping, denial of service attacks or any action that compromises the availability of the service;

6) use the website for commercial, advertising or recruitment purposes without authorisation;

7) reproduce the hospital's visual identity in a way that suggests a connection or endorsement that does not exist.

Automated access to the transparency portal is permitted and provided for by law, including through the open data format we offer, provided it does not compromise the availability of the service.

5. Ombudsman

The ombudsman receives compliments, suggestions, complaints, reports of misconduct, questions and requests.

1) A report may be anonymous. If you choose to identify yourself, name, e-mail address and telephone number are mandatory, because without a means of contact we cannot reply to you.

2) When you file a report, you receive a reference number and an access code. They are the only way to follow an anonymous report, and must therefore be kept safe: we cannot recover them afterwards.

3) We will treat the report with the appropriate confidentiality, subject to legal duties of investigation and of notification to the authorities.

4) A knowingly false report may expose its author to legal liability.

6. WhatsApp service channel

1) The channel operates during business hours, and messages are answered in the order they arrive.

2) It is not an emergency channel, as stated in the notice at the beginning of these Terms.

3) Avoid sending more health information than is necessary for what you need.

4) We use the official WhatsApp Business platform exclusively. Be wary of any contact claiming to be from the hospital using a different number, and check the official number on this website.

7. Transparency portal

The documents published are public information, freely usable with attribution of the source. We also make them available in an open, machine readable format, in compliance with Law number 12.527/2011.

8. Intellectual property

The brand, the name, the logo, the texts, the images and the visual design of the website belong to the hospital or to third parties who have authorised their use, and are protected by the applicable legislation.

You may quote and share the content with attribution of the source. You may not use it commercially or reproduce the visual identity without authorisation.

9. Availability

We aim to keep the website continuously available, but it may become unavailable for maintenance, because of technical failure or for reasons beyond our control. We do not guarantee uninterrupted availability.

10. Links to other websites

The website may contain links to third party pages, such as public bodies and social networks. We have no control over that content and are not responsible for it. By following a link, you become subject to the terms and the privacy policy of the destination.

11. Limitation of liability

To the fullest extent permitted by law, the hospital is not liable for damages arising from:

1) use of the informative content of the website as a substitute for professional care;

2) temporary unavailability of the website or of the digital channels;

3) use of the digital channels for emergency situations, contrary to the notice in these Terms.

Nothing in this clause excludes the liabilities imposed by law, in particular those arising from the Brazilian Consumer Protection Code and from the care relationship.

12. Privacy

The processing of your personal data is described in the Privacy Policy and in the Cookie Policy, which form part of these Terms.

13. Changes

We may change these Terms. Each version is numbered and dated, and previous versions remain available in the version history on this page. Use of the website after a change implies agreement with the version in force.

14. Governing law and jurisdiction

These Terms are governed by Brazilian law. The courts of the district of Martinópolis, State of São Paulo, are elected to settle disputes, without prejudice to the consumer's place of domicile where applicable.
